Introduction

Welcome to ZipLove! These Terms of Service ("Terms") govern your use of the ZipLove mobile application and website (collectively, the "Service") operated by ZIPLOVE LLC ("ZipLove," "we," "us," or "our").

By creating an account and using ZipLove, you agree to be bound by these Terms. If you do not agree, please do not use our Service.

By accessing or using ZipLove, you agree to:

If you are using ZipLove on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

2.1 Age Requirement

You must be at least 18 years old to use ZipLove. By creating an account, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into this agreement
  • You are not prohibited from using the Service under applicable law

2.2 Account Restrictions

You may not create an account if you:

  • Have been previously banned from ZipLove
  • Are a convicted sex offender
  • Are prohibited by law from using dating services

3. Account Registration and Security

3.1 Account Creation

To use ZipLove, you must:

  • Provide accurate, current, and complete information
  • Use your real name and real photos
  • Provide a valid email address and phone number
  • Verify your phone number via SMS
  • Be assigned to a territory based on your ZIP code

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

We are not liable for any loss or damage arising from unauthorized account access due to your failure to maintain security.

3.3 One Account Per Person

You may only create and maintain one ZipLove account. Creating multiple accounts may result in termination of all your accounts.

4. Territory-Based Matching

ZipLove uses a unique territory system:

  • Users are assigned to a local territory based on their ZIP code
  • Territories group 15-40 ZIP codes together
  • You can only match with users in your assigned territory
  • Changing your ZIP code may change your territory assignment

You understand and agree that:

  • Territory assignments are determined by ZipLove
  • We may modify territory boundaries at any time
  • Moving to a new ZIP code requires updating your profile

5. User Conduct and Prohibited Activities

5.1 Acceptable Use

You agree to use ZipLove for its intended purpose: meeting and connecting with other single adults in your local area.

5.2 Prohibited Conduct

You may NOT:

  • Harass, bully, stalk, or threaten other users
  • Post explicit, obscene, or pornographic content
  • Impersonate any person or entity
  • Use fake photos or provide false information
  • Solicit money or financial information from other users
  • Promote prostitution, escort services, or illegal activities
  • Spam or send unsolicited commercial messages
  • Use the Service if you are married or in a committed relationship (unless you clearly disclose this)
  • Share others' private information without consent
  • Use automated tools, bots, or scrapers
  • Attempt to hack, disrupt, or damage the Service
  • Violate any local, state, national, or international law

5.3 Profile Content

Your profile photos and bio must:

  • Show your real, unaltered face
  • Be appropriate for all audiences (no nudity or sexually explicit content)
  • Not include contact information or promotional content
  • Not include images of other people without their consent
  • Not contain hateful, violent, or discriminatory content

5.4 Messaging Conduct

When messaging other users, you must:

  • Be respectful and courteous
  • Not send sexually explicit or harassing messages
  • Respect others' boundaries and respond to "no" appropriately
  • Not share personal contact information prematurely (use good judgment)

6. Intellectual Property

6.1 ZipLove's Property

All content, features, and functionality of the Service, including:

  • The ZipLove name, logo, and branding
  • Software, code, and technology
  • Design, layout, and user interface
  • Text, graphics, and materials

...are owned by ZIPLOVE LLC and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of content you post (photos, bio, messages). However, by posting content on ZipLove, you grant us a:

  • Worldwide, non-exclusive, royalty-free license
  • To use, display, reproduce, and distribute your content
  • For the purpose of operating and promoting the Service
  • This license ends when you delete your content or account

6.3 Feedback

If you provide feedback, suggestions, or ideas about ZipLove, we may use them without any obligation to you.

7. Subscriptions and Payments

7.1 Free and Paid Features

ZipLove offers both free and paid subscription features. Paid subscriptions provide access to premium features such as:

  • Unlimited matches
  • Advanced filtering
  • Read receipts
  • Profile boosts
  • And other premium features

7.2 Subscription Terms

  • Subscriptions are managed through RevenueCat
  • Billing is handled through Apple App Store or Google Play Store
  • Subscriptions auto-renew unless cancelled
  • Prices are displayed in the app and may change with notice

7.3 Event Tickets and Merchandise

  • ZipLove may offer tickets to local events and branded merchandise
  • Payments are processed through Square
  • All sales are final unless otherwise stated
  • Event tickets are non-transferable

7.4 Refund Policy

  • Subscription refunds are subject to Apple/Google's refund policies
  • Contact info@ziplove.org for refund requests
  • We evaluate refund requests on a case-by-case basis
  • Event tickets are generally non-refundable

7.5 Payment Information

We do not store your payment information. All payments are processed securely by:

  • Apple App Store (for iOS subscriptions)
  • Google Play Store (for Android subscriptions)
  • Square (for events and merchandise)
  • RevenueCat (subscription management)

7.6 SMS Communications

SMS Opt-In

By checking the SMS opt-in box during registration, you consent to receive SMS notifications from ZipLove, including:

  • Account alerts
  • Match notifications
  • Message notifications
  • Security alerts

SMS Terms

  • Consent is optional and separate from Terms of Service
  • Message frequency varies based on your activity
  • Standard message and data rates may apply
  • Reply STOP to any SMS to unsubscribe immediately
  • Reply HELP for assistance
  • Supported carriers: AT&T, Verizon, T-Mobile, Sprint, and other major U.S. carriers

This number is for outbound notifications only. For customer support, email info@ziplove.org.

Your SMS Responsibilities

You agree to:

  • Provide an accurate phone number
  • Maintain sufficient cellular service
  • Pay any carrier charges for SMS delivery
  • Not use SMS for prohibited content

Our SMS Rights

We may suspend or terminate SMS services if:

  • You violate these Terms
  • Your carrier blocks our messages
  • Technical issues prevent delivery
  • You send prohibited content via SMS

Prohibited SMS Content

The ZipLove platform does not permit or support any sexually explicit or suggestive SMS conversations. Violations will result in immediate account termination.

SMS Provider

SMS services are provided by Telnyx.

8. Events and Meetups

8.1 ZipLove Events

We may organize local events and meetups for users in specific territories. By attending, you agree to:

  • Follow all event rules and guidelines
  • Behave respectfully toward other attendees
  • Comply with venue rules and local laws
  • Assume all risks associated with attendance

8.2 Liability

ZipLove is not responsible for:

  • Interactions between users at events
  • Injuries, accidents, or incidents at events
  • Third-party conduct at events
  • Venue conditions or safety

You attend events at your own risk.

9. Safety and Reporting

9.1 Your Safety

ZipLove takes safety seriously, but we cannot guarantee the conduct of our users. You are responsible for:

  • Using good judgment when meeting people
  • Meeting in public places for first dates
  • Telling friends/family about your plans
  • Not sharing sensitive personal information prematurely
  • Reporting suspicious or harmful behavior

9.2 Reporting Violations

If you encounter a user who violates these Terms, please report them immediately:

  • Use the in-app reporting feature
  • Email info@ziplove.org with details
  • We investigate all reports promptly

9.3 Background Checks

ZipLove does not conduct criminal background checks on users. You are responsible for your own safety and due diligence.

10. Termination

10.1 Your Right to Terminate

You may delete your account at any time through the app settings or by contacting info@ziplove.org.

10.2 Our Right to Terminate

We may suspend or terminate your account immediately, without notice, if you:

  • Violate these Terms
  • Engage in prohibited conduct
  • Provide false information
  • Are reported for harassment or abuse
  • Pose a safety risk to other users
  • Attempt to defraud or harm the Service

10.3 Effect of Termination

Upon termination:

  • Your access to the Service ends immediately
  • Your profile and content are deleted
  • Outstanding subscription fees remain due
  • Sections of these Terms that should survive termination (like liability limitations) remain in effect

11. Disclaimers

11.1 Service "As Is"

ZipLove is provided "as is" and "as available" without warranties of any kind, either express or implied, including:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Guarantees of uninterrupted or error-free service
  • Guarantees of specific results or matches

11.2 No Guarantee of Results

We do not guarantee that you will:

  • Find a match or relationship
  • Meet compatible people
  • Have a successful dating experience

11.3 User Content

We are not responsible for:

  • The accuracy of user profiles or information
  • User conduct or interactions
  • Offensive, inaccurate, or inappropriate user content

11.4 Third-Party Services

We are not responsible for:

  • Third-party websites, services, or links
  • Payment processor errors or issues
  • Third-party service outages or failures
  • SMS delivery failures due to carrier issues

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

12.1 No Liability

ZIPLOVE LLC, its officers, directors, employees, and agents are NOT LIABLE for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Personal injury or property damage
  • Emotional distress
  • Damages arising from your use of the Service
  • Interactions with other users (online or in person)
  • SMS delivery failures or delays

12.2 Maximum Liability

Our total liability to you for any claims arising from your use of ZipLove shall not exceed:

  • The amount you paid to ZipLove in the 12 months before the claim, OR
  • $100, whichever is greater

12.3 Acknowledgment

You acknowledge that:

  • Meeting people online involves inherent risks
  • We cannot control user behavior
  • You are responsible for your own safety and decisions
  • These limitations are reasonable given the nature of the Service

13. Indemnification

You agree to indemnify, defend, and hold harmless ZIPLOVE LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person
  • Your content or conduct on ZipLove
  • Your interactions with other users

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of Kentucky and the United States, without regard to conflict of law principles.

14.2 Informal Resolution

If you have a dispute with ZipLove, please contact us first at info@ziplove.org to attempt to resolve it informally.

14.3 Arbitration Agreement

BY USING ZIPLOVE, YOU AGREE TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION, NOT COURT.

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA), except:

  • Small claims court actions (under $10,000)
  • Intellectual property disputes
  • Requests for injunctive relief

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND CLASS ACTION.

14.4 Exceptions

The following may be brought in court without arbitration:

  • Claims for intellectual property infringement
  • Small claims court actions
  • Requests for injunctive or equitable relief

14.5 Class Action Waiver

You agree to bring claims against ZipLove only in your individual capacity, not as part of a class action or representative proceeding.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZipLove.

15.2 Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the app and on our website
  • Sending an email notification
  • Displaying an in-app notification

Your continued use after changes are posted constitutes acceptance of the new Terms.

15.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.4 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

15.5 Assignment

You may not assign or transfer these Terms. We may assign these Terms to any affiliate or successor.

15.6 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control (e.g., natural disasters, wars, pandemics, internet outages).

16. Apple App Store and Google Play Terms

16.1 Apple App Store

If you download ZipLove from the Apple App Store, you acknowledge that:

  • These Terms are between you and ZIPLOVE LLC, not Apple
  • Apple has no obligation to provide support for the app
  • Apple is not responsible for any product liability claims
  • Apple is a third-party beneficiary of these Terms and may enforce them

16.2 Google Play Store

If you download ZipLove from Google Play, you agree to Google Play's Terms of Service.

The following sections survive termination of your account or these Terms:

  • Intellectual Property
  • Payment obligations
  • Disclaimers
  • Limitation of Liability
  • Indemnification

BY CLICKING "I AGREE" OR BY USING ZIPLOVE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
